The Terms of Use (referred to as “Terms”) constitute a legally binding agreement  (referred to as “Agreement") between the User who visits the Website in connection with use of our services, or whose information Company otherwise receives in connection with the services provided through its education business (referred to as “You”) and the Company governing Your access to and use of the Platform, including any sub-domains thereof, and any other websites through which the Website makes its services available (referred to as "Site"), our mobile, tablet and other smart device applications, and application program interfaces (referred to as "Application"). The Application and Site are collectively termed as (referred to as "Platform").

 

The following are the terms and conditions of accessing or using any of our website, mobile site, mobile app etc. (hereinafter “Platforms”) developed and operated by M/s Ratio Technologies and our affiliated companies (hereinafter "Dial4college").

 

Access to any part of the Platform or any content downloaded from it is contingent on Your acceptance of and compliance with these Terms and Privacy Policy. If You do not understand and agree to be bound by all Terms and the Privacy Policy, do not use this Platform.

 

Registration

• Registration on our Platforms is free.  Although parts of our Platform may be visited by anyone, You will need to register as a member to access some of the features on the Platform
• To be eligible to register, You must confirm that you are over 18 years of age.
• You agree that, after registration, all information provided by You to us about Yourself is true, accurate, up-to-date and complete at any given time.  We reserve the right to terminate Your membership and accessibility to our Platform if it is learnt that You have provided false or misleading information.
• By registering, You agree to make your contact details available to our partners / business associates of the Platform, receive promotional mails/ updates from the Platform or any of its partners or business associates. You may be contacted by platform, partner educational institutions / service providers for additional information through email, telephone, SMS or  WhatsApp.
• When You register, your email ID may be used as your username. The login process is through an OTP that will be sent to your registered email address and / or mobile number.
• We have the absolute discretion to cancel your username/password at any time if we suspect it is being used by an unauthorized person.
• Be contacted by Dial4college.com in accordance with the settings set by You.

 

Purpose of Platform

Our Platform is made available for use to help the users get details, discover & research Colleges, Courses and Exams of their interest and for allied services related thereto. The Platform also helps connect colleges/educational institutes/coaching centres etc. with prospective students who may be of interest in them. Study Abroad section of Platform also assists students in completing and submitting their applications to universities abroad.

 

Use of Platform to be in Conformity with the Purpose

The Platform or Service or Product that You subscribe to or use (whether the same is paid for by You or not) is meant for the Purpose and only Your exclusive use. Copying or downloading or recreating or sharing passwords or sublicensing or sharing in any manner which is not in accordance with these terms, is a misuse of the Platform or Service or Product and Company reserves its rights to act in such manner as to protect its loss of revenue or reputation or claim damages including stopping Your service or access and reporting to relevant authorities.  In the event You are found to be copying or misusing or transmitting, scraping or crawling any data or photographs or graphics or any information available on the Platform or Service of Product for any purpose other than that being a Bonafide purpose, we reserve the right to take such action that we deem fit including stopping access and claiming damages.

Accuracy and correctness of the information provided by You:

1. 1. Whilst using this Platform, You have an obligation  an obligation to only provide true and correct information and in the case of creating a profile. You undertake to keep the information up to date at all times.
   2. We reserve the right to remove/suspend any content or profile providing false / incorrect or incomplete or outdated information or masquerading  / impersonating as someone else.
   3. Keep Your contact details up to date. Wrong and false details by themselves can be a cause for termination of services. Also as a consequence we may not be able to reach You.

Security of Log in credentials and Responsibility of content/activities:

   5. If You have registered on the Platform, the safety and security of Your login credentials is Your responsibility, do not share these with anyone.
   6. You are fully responsible for all activities that occur under the account and any other actions taken in connection with the Platform
   7. The Platform may contain links to third party websites/apps, these links are provided solely as convenience to You and the presence of these links should not under any circumstances be considered as an endorsement of the contents of the same, if You choose to access these websites/apps You do so at Your own risk.

 

Use of Content in our Platform by You

* All information, documents, software, images, photographs, text, services and other similar materials (collectively "Materials") contained in this platform are provided by Dial4college or its third-party manufacturers, authors, developers and vendors ("Third Party Providers") and are the copyrighted work of Dial4college and/or the Third Party Providers. Except as stated herein, none of the Materials may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means, including, but not limited to, electronic, mechanical, photocopying, recording, or otherwise, without the prior express written permission of Dial4college or the third-Party Provider.

* No portion of the Platforms, including logos, graphics, sounds or images, may be reproduced or retransmitted in any way, or by any means, without the prior express written permission of Dial4college.

* You agree that the following actions are prohibited:

• Copying, extracting, downloading, sharing, displaying, selling, or otherwise exploiting any content, data, information, photos, images, preparation material, questions and solutions available on the Platforms
• Using or exploiting Platforms and any content or data or information or test preparation material provided there in for any commercial purposes without prior written consent of the
• Gaining or attempting to gain unauthorized access to any portion of the Platform which is not intended for your use.
• Using any software or automated programs or any process to access, navigate, copy, download, crawl, scrape or extract any manner any data, content information, test preparation material from the Platform
• Reverse engineering, decompiling, deciphering or deriving the source code for the Platform.
• Impersonating any other person or entity or making any misrepresentation of the information shared about you.
• Stalking, threatening, spamming or in any manner harassing any other use of the Platform
• Imposing an unreasonable or large load on the infrastructure of the Platforms.

* For the purposes of these terms, “content” refers to all data, text, logos, artwork, software, documents, images, photographs, learning material and other materials downloaded from our platforms. This also includes any material you may upload including information about yourself, and comments about your experience as a student or about your study interests etc.

* You must ensure that any content that You submit to our platforms

• Does not infringe any third party's intellectual property
• Does not breach any applicable law.
• Is not defamatory, profane, sexually or racially offensive or discriminating, harassing, threatening, obscene, pornographic, false, unreliable or misleading or otherwise objectionable in our opinion.

• Does not disrupt the online community on our platforms.

 

You agree that You will not use our platforms

• For commercial purposes or to obtain financial gain without our prior written consent.
• To send chain letters, junk mail, ‘spam’, business or bulk communications of any kind.
• To advertise a company, product or service of any educational establishment except under the terms of a written advertiser agreement that we have entered into with you.
• In a way that might reasonably be expected to cause another person's computer systems and/or their communications network to be interrupted, damaged or rendered less efficient.
• To obtain personal information from users in a non-transparent or deceptive way.
• To obtain passwords or personal identifying information for commercial or unlawful purposes from other users.
• To attempt to impersonate another user.
• To harass, threaten, or intimidate any user

* You must log out from your registered account at the end of each session on our platform

* If You are a visitor, You agree not to obtain unauthorized access to areas of our platform reserved for members

* If You are aware of anything on our platform which appears to infringe these terms, you agree to contact us immediately.

* If You are a university, college, school, other educational institution, educational service provider or any other entity partnered with Dial4college where Dial4college shares details of students who have expressed willingness to apply for your programs:

• You will comply with all applicable data protection laws in relation to the processing of personal data; and not process personal data in an unlawful manner as defined in the privacy policy and this terms and conditions
• You shall implement adequate technical and organizational controls to protect the shared personal data obtained from the Company against unauthorised or unlawful processing and against accidental loss, destruction, damage, alteration or disclosure
• You warrant and represent that the institution shall not disclose or transfer Personal Data obtained from the Company to any sub-processors without ensuring that adequate and equivalent safeguards to the Personal Data
• You shall retain or process shared Personal Data for no longer than is necessary to carry out the agreed purposes.

 

 

 

Under 18 Years of Age

* If You are under 18 years of age and want to become a member, You must obtain a parent or guardian's permission before registering on our platform. You may also discuss these terms with them before obtaining their permission.

* If You are a member under 18 years of age, You will need to obtain a parent or guardian's permission before taking part in any online discussions. You should never reveal personal information about yourself, such as your address, telephone number, and school name etc., to other users.

* You cannot register on our Platforms if You are less than 13 years old. We do not intentionally collect or maintain personal information of those who are under 13 years of age.

Intellectual Property Rights

* All the content, material, trademarks, service marks, trade names, software, text, script, images, graphics, videos, audio, preparation material with questions and solutions etc. contained in the Website, Application, Products / services are proprietary property of the Company (“Intellectual Property”) and protected by the governing laws and regulations in India.

* You may view, print, download or temporarily store such content for your personal, non-commercial reference without alteration, addition or deletion. You may not otherwise copy, reproduce, retransmit, distribute, publish, commercially exploit or otherwise transfer such content. You acknowledge that you will not acquire any intellectual property rights by downloading or otherwise using any such content

* All other trademarks, service marks and logos used on the Platforms are trademarks, service marks and logos of their respective owners like universities, colleges, schools, educational service providers, organizations etc.

* Dial4college respects intellectual property rights of any third party. If we receive any communication with regard to any possible infringement of any intellectual property right of any third party, we shall remove the infringing content from the Platforms and terminate the account of the associated user.

* When You submit content on the Platforms, You grant us a royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute and communicate to the public such content.

Cookies

When we provide You with our services, we want to make them easy, useful and reliable. Where services are delivered on the internet, sometimes involves placing small amounts of information on your device, for example, computer or mobile phone. These include small files known as ‘cookies’. They cannot be used to identify You personally.  These pieces of information though, are used to improve services for You by:

• Enabling our Platform to recognise your device so You don't have to give the same information several times during one task and presenting You with the most relevant courses, programs, reviews and scholarships.
• Recognising that You may already have given a username and password so You don't need to do it for every web page requested, for example when enquiring to universities and colleges.
• Measuring how many people are using our sites, so they can be made easier to use and there's enough capacity to ensure they are fast.

You can manage these on your own.

Refund / Cancellation Policy

Amount paid towards products purchased will neither be refunded nor adjusted under any circumstance. Our customer service team would be available to address any concerns related to the product and services rendered by us.

However, if You have purchased products under ‘guaranteed success’ facility, the amount would be returned in case of not meeting the minimum guarantee promised, provided that You have engaged with the portal with minimum number of hours and taken up a minimum number of tests specified against each such package sold under such facility.

 

Disclaimer for websites that we link to

We do our best to ensure that:

• the websites/apps we select for inclusion in the Platform work, and continue to work properly;
• their content remains acceptable and useful; and
• their operation will not be injurious to our users' devices.

 

 

We outright disclaim, and will not accept any responsibility for any of the following in respect of the sites that we link to:

• Infection by computer viruses
• Damage caused by downloaded software
• Technical problems, failures and speed of operation
• Defamatory, denigratory or illegal material

• The quality or truth of any material, or advice that is offered

 

Privacy

The Privacy Policy of the Platform explains how we may use Your personal data, we will at all times respect and ensure adherence to the privacy policy, additionally various settings are provided to help You to be able to control the manner in which others may be able to view Your information as chosen by You to be displayed on Your profile and the manner in which You may have chosen to be contacted. Any feedback provided by a user shall be deemed as non-confidential to the user.

Terms of conditions specific for educational institutions/colleges etc. (as applicable):

• You will comply with all applicable data protection laws in relation to the processing of personal data; and not process personal data in an unlawful manner and excessive with regard to agreed purposes as defined in the privacy policy and this terms and conditions
• You shall implement adequate technical and organizational controls to protect the shared personal data obtained from the Company against unauthorised or unlawful processing and against accidental loss, destruction, damage, alteration or disclosure
• You agree to provide reasonable assistance as is necessary to facilitate the handling of any Data Security Breach (as applicable under GDPR or any other privacy law as applicable) in an expeditious and compliant manner
• You agree that the responsibility for complying with a data subject request lies with the Party which holds/processes the Personal Data collected/shared
• You warrant and represent that the institution shall not disclose or transfer Personal Data obtained from the Company to any sub-processors without ensuring that adequate and equivalent safeguards to the Personal Data.
• You shall retain or process shared Personal Data for no longer than is necessary to carry out the agreed purposes.

Platform and the educational institutions etc. (as applicable) would act as independent controllers in their respective capacity.

Applying to Educational Institutions

* If You are applying to any college / university (Institution) by using ‘Common Form’ or any other mode on our Platforms, You will take complete responsibility for the completeness and accuracy of the personal and academic information submitted in the application form provided. You undertake and agree that the information submitted in the Form is factually true and correct

* You understand that You will have to check the eligible criteria for the programs for which applications is being made and apply for only those Institutions which meet your requirements

* You authorize Dial4college to share the information provided by You with Institutions to whom You are applying

* The information submitted in ‘Common Form’ is not a complete application form and Institution may contact You for additional information, if required

* You agree to notify the Institutions to whom You have applied to if there is any change in the information submitted in the Application Form

* You understand that any changes in the information made after application is submitted would not be shared with the Institutions. You need to contact the institution directly, if You wish to change any information submitted in the Form

* Applying through ‘Common Form’ or any other application form does not give any guarantee admission, or provide any preference in application process

* The Institutions for whom applications are allowed  through ‘Common Form’ or through any other similar feature are our advertisers / partners and it is your responsibility to review the details of the Institutions and their programs before applying.

 

Payment terms

You are requested to honour your payment obligations to the company.

Payments for the services offered by the Platform shall be on a 100% advance basis. The payment for service once subscribed to by You is not refundable and any amount paid shall stand appropriated. Refund, if any, will be at the sole discretion of the Company.

User hereby irrevocably accepts to receive the tax invoice as soft copy through emails.

 

Counseling Services

* The Counselling services and the information, recommendations, advices and other services provided to you on or through the Counselling sessions / Webinars / WhatsApp Text/Call etc. are intended to provide information and guidance only and do not constitute any commitment of performance/admission of the user in any manner.

* Dial4college will keep the content/information/data provided through the counseling services correct but does not guarantee that the information/data is free of errors, defects etc.

* Information provided by the counselors/experts through the counseling services would be based on the expert's analysis backed by data, past experience, etc.  Dial4college will not be responsible for the decision taken by the users on the basis of Expert advice/guidance.

* You will have to check the eligibility criteria for the programs for which applications are being made and apply for only those Institutions which meet your requirements.

 

Indemnification

You agree to indemnify, defend and make good Dial4college employees, contractors, licensors, third party suppliers, partners, from any claims, losses, damages, liabilities and expenses arising out of any use or misuse of the Platforms, infringement of intellectual property rights, any violation of the Term or any breach of the representations, warranties made herein.

Warranties and Disclaimers:

* Dial4college makes reasonable efforts to ensure that the Platforms are safe to use.  You understand and agree that your use of the platforms, the content, products and services is at your sole risk. All content and material on the platforms are provided on an AS IS and AS AVAILABLE basis. Dial4college expressly disclaims all warranties and conditions of any kind whether express or implied.

*Dial4college makes no warranty that the content and services are accurate, timely and error free and are uninterrupted and virus free.  Any errors in the products and services will be corrected

* Though the website has been designed with utmost care, due to some inevitable error quotient in human working, the graphics and documents may have some typographical or technical errors which will be removed or edited from time to time as the website will be updated. You understand and agree that we do not guarantee the accuracy, relevancy or completeness of any information in or provided on or from our platforms. Purchasing and Ordering Disclaimer

Limitation of liability

* In no event shall the Company, its Affiliates, Directors, Officers, Employees, Partners, Advertisers, Licensors, Suppliers or Agents be liable to You or any third party for any special, incidental, indirect, consequential, punitive or exemplary damages whatsoever, including those resulting from loss of use, data or profits or any other claim arising out of or in connection with, your use of, or access to the Platforms

* Except as required by law, we will not be liable for any direct losses or damages arising in contract, tort (including negligence) and for any reason.

Governing Law

The terms and conditions shall be governed by and construed in accordance with laws in force in India. Any disputes arising herefrom, shall be subject exclusively to the jurisdiction of the courts of law in Chennai, India.

You acknowledge that You have read and accepted these terms and conditions. If You do not agree to these terms and conditions, You may choose not to become a user of our Platforms.

Taxes

Any reference to duties and taxes etc in these Terms of use shall include Goods and Services Tax (GST) or Value Added Tax (VAT) as per local jurisdiction or any other similar tax or duty, by whatever name called (herein referred TO as GST) and shall be charged in addition to the basic amount, in accordance with respective laws & regulations.

You are required to provide true & correct information as required under tax laws, In case of any discrepancy or change, the user is required to promptly intimate the correct or updated particulars to the company. The company shall be entitled to seek indemnification from users if it is required to pay any tax, duty, fee, interest or penalty in view of incorrect or incomplete information or data furnished by user or not got rectified/ updated by user timely.

 

Termination/Suspension

The Company may, without notice in its sole discretion, and at any time, terminate or restrict your use or access to the Platform (or any part thereof) for any reason, including, without limitation, that the company based on its judgement and perception believes You have violated or acted inconsistently with the letter or spirit of these terms of use.

 

Miscellaneous

Amendment to these Terms

The company reserves its right to amend / alter or change all or any disclaimers or Term(s) or Condition(s) of agreements at any time without any prior notice.
